At-Will Employment

What is At-Will Employment?

At-will employment is a term used primarily in the United States to describe an employment arrangement in which either the employer or the employee can terminate the employment relationship at any time, for any reason, or for no reason at all, without prior notice. This type of employment does not have a specified duration and is not contingent on just cause for termination.

Legal Framework and Limitations

While at-will employment allows for flexible employment relationships, there are several legal limitations to protect against unfair dismissals. For instance, an employer cannot terminate an employee for reasons that violate federal anti-discrimination laws, such as race, gender, age, or religion. Additionally, terminations that violate public policy or contractual agreements are also not permissible under the at-will doctrine.

Employees under at-will employment have rights that safeguard them from wrongful termination.
