Employee offboarding

When terminating an employee in Gibraltar, an employer must give a notice of termination, seven days prior to dismissal date. Failing to do so might result in a fine amounting to GIP 750.

Employees that are dismissed on grounds of misconduct have the right to appeal their case to their employers. An employer’s obligation is to inform the employee of the allegations and conduct a proper investigation on the matter. A disciplinary hearing might also be necessary in the process.

The notice period will depend on whether the employee is under probation or not. One month’s notice is required for regular employees. For employees under probation, a one week notice is expected. 

Employees with a fixed-term contract that are dismissed before their contract expires are entitled to 50% of the salary that would have accrue if the employee follows their end of contract.
